Maternity leave in india is a paid leave of absence from work that allows women employees the benefit of taking care of their new born baby, and at the same time retain their jobs.

(Amendment) 2017 has extended the earlier 12 weeks leave to 26 Weeks ”   

Women employees whose monthly gross salary is less than Rs. 21000/- can get a maternity leave salary up to 26 weeks. If her monthly gross salary is more than Rs.21000/- will get maternity leave amount for 26 weeks from their employer under maternity benefits act 1961

Maternity Leave Benefit:-

  • Maternity leave is a paid leave of absence from work.
  • Maternity Leave helps to retain their jobs in same concern.
  • Totally 26 weeks maternity leave for taking care of their newly born baby.
  • The Pregnant employee can take the leave as post and Pre-delivery
  • 8 weeks of leave can opt before the delivery and remaining 18 weeks can take after child birth.

  • The maternity law states a 12 weeks leave for adopting mother.
  • The adoptive mother leave starts from the day of adoption and is applicable for the baby below three months of age.
  • The Biological mother who imparts her egg to create an embryo which is then planted in another woman.
  • Tubectomy during pregnancy can opt for two weeks leave immediately from the date of the tubectomy operation.

Eligibility and Rule for ESIC Maternity Claim.

  • Woman employee should work minimum 9 month service and 70 days of contribution towards in ESIC between April to September or October to March.
  • Employees can check their eligibility for ESIC maternity claim at ESIC IP portal.

Documents Required For Maternity Benefit Payment :

  • Original Copy of medical Certificate issued by IMO, ESI Dispensary
  • Original Copy of Medical Certificate issued by maternity Hospital
  • Photocopy (Xerox) of Discharge Summary
  • Original Birth Certificate
  • Photocopy (Xerox) copy of bank passbook
  • Photocopy (Xerox) copy of E-Pehchan Card along with addition of new born baby name
  • Photocopy (Xerox) copy of Marriage certificate or Original marriage card ( if insured woman has not changed his name/surname after marriage)
  • Claim Form 19 duly signed by the employer.
  • Self Declaration of IW for surviving surviving children for maternity benefit claim-duly countersigned by the Employer.

How to claim ESI Maternity Benefit

  • A pregnancy woman before 8 weeks from the date of delivery they can take maternity leave and after that they can continue maternity leaves up to 18 weeks after the delivery
  • Maternity leave (as per April 2017 amendment ) 26  weeks (They can be availed in 8 weeks and 18 weeks)
  • Before taking maternity leave insured woman should visit their local  ESIC Dispensary and take a medical certificate from them regarding pregnancy.
  • Submit ESIC Self declaration form to ESIC office through your employer.
  • Before or after of maternity leave submit maternity claim form 19 (Click Here to Download Form 19) to ESIC office
  • After completing the remaining 18 weeks of maternity leave submit form 21 and Form 23 to beneficiary’s allotted ESI dispensary.
